Supremo Tribunal Federal e sua natureza jurídica: Corte Constitucional ou órgão de cúpula do judiciário brasileiro?

    This scientific paper aims to analyze the legal nature of the Brazilian Supreme Court, a very common issue when the object of discussion is the Court’s competency and its boundaries, in order to justify – or not – it’s operation in certain matters. The research develops itself by showing, firstly, important considerations about the separation of powers. After that, it shows how the Judicial branch works, and also the functions given to the Courts in Brazil. In the end, the legal nature of the Brazilian Supreme Court is analyzed, considering what is usually thought in doctrine as a Constitutional Court, as good as the competencies given to STF by the Brazilian Constitution. As a result, we conclude that STF is actually an hybrid Supreme Court, once it mixes natural Constitutional Courts attributions with other different competencies. The scientific method that was used the most during this research is the deductive one, after reading many legislative, bibliographic and documental sources

    O presente artigo científico visa analisar a problemática da natureza jurídica do Supremo Tribunal Federal, questão recorrente quando se discute as competências da Corte e seus limites, de modo a justificar ou não a sua atuação em determinada matéria. A pesquisa se desenvolve apresentando, preliminarmente, importantes considerações acerca da separação de poderes. Prossegue adentrando no estudo do Poder Judiciário e das funções atribuídas aos tribunais no Brasil. Por fim, se debruça na análise da natureza jurídica do Supremo Tribunal Federal, tendo em vista o paradigma do que se considera uma Corte Constitucional na doutrina e o que a Constituição Federal traz de competências para o Tribunal brasileiro.Como resultado, concluiu-se que se trata de uma Suprema Corte híbrida, misturando competências próprias de Cortes Constitucionais com outras mais similares às de uma simples instância do Poder Judiciário. O método dedutivo foi o mais utilizado nessa pesquisa, a partir da leitura de fontes legislativas, bibliográficas e documentais
