    Esta contribución tiene como objeto desarrollar el enfoque del ius constitutionale commune en América Latina (ICCAL) en torno al constitucionalismo transformador regional, mediante el análisis de El concepto de lo político de Carl Schmitt. Este análisis articula el ICCAL diferenciándolo de la actual reacción nacionalista, centrada en los Estadosnación;

    enuncia las debilidades conceptuales de esta reacción y propone una alternativa con el programa normativo del constitucionalismo transformador latinoamericano. Asimismo, discute mediante la crítica del texto de Schmitt, criterios para la construcción teórica del derecho público, y también refleja el ICCAL como teoría jurídica.

    This contribution has as purpose to develop the ius constitutionale commune approach in Latin America (ICCAL) about Regional Transforming Constitutionalism by means of the analysis of The Concept of Politics of Carl Schmitt. This analysis articulates ICCAL making it differ from the current nationalist reaction, focused on the States of the Nation; it enunciates the conceptual weaknesses and proposes an alternative with the normative program of Latin American Transforming Constitutionalism.

    Likewise, it discusses by means of a criticism of Schmitt’s text the theoretical constitution of public law; and it also portrays ICCAL as legal theory.
