The principle expressed by the supreme Court of cassation that the court of enforcement is not allowed to increase the penalties imposed for each of the offenses committed continuously is fully comprehensible. The Court's reasoning is, however, contradictory in that, even though it recognizes an atomistic nature of the ongoing offense, it uses the term "satellite crimes", whose semantics, as the Author explains, is symptomatic of a procedural defect that often connotes the quantification of the legal cumulation of penalties: the continuing violation of art. 533, co., 2 c.p.p.

Il principio espresso dal supremo consesso della Corte di cassazione, secondo cui non è consentito al giudice dell'esecuzione incrementare le pene stabilite per ciascuno dei reati commessi in continuazione, è pienamente condivisibile. Il ragionamento espresso dalla Corte però è contraddittorio nella parte in cui, seppure riconosce una natura atomistica al reato continuato, usa l'espressione “reati satellite”, la cui semantica, come spiega l'Autore, è sintomatica di un vizio procedurale che spesso connota la quantificazione del cumulo giuridico delle pene: la perdurante violazione dell'art. 533, co. 2, c.p.p.
