    Las personas, en general, toman en consideración el destino que quieren dar a sus bienes para después de su muerte. Cuando se enfrentan a tal decisión se preguntan si tienen libertad para regular su sucesión mediante un instrumento hábil para ello, y, en su caso, si la tienen para decidir su contenido, o bien han de someterse a restricciones. El instrumento que tiene el protagonismo para conseguir ese fin es el testamento, y dentro de él el abierto. Por ello es de suma importancia la capacidad del testador para otorgarlo, y evitar, en su caso, que, de ser vulnerable, vea mediatizada su voluntad. Es objeto de análisis si puede imponer condiciones a sus disposiciones testamentarias, y el tema estrella, como límite al contenido de la libertad de testar, es el relativo a la legítima

    People, in general, take into consideration the fate that want to give their goods for after his death. When faced with such a decision are wondering if they have freedom to regulate his succession by an instrument working for it, and, where appropriate, if they have to decide on its content, or you have to submit to restrictions. The instrument which has the role to achieve that end is the Testament, and within it the open. Therefore it is of utmost importance the capacity of the testator to grant it, and avoid, in his case, of being vulnerable, see mediated his will. It is object of analysis if it can impose conditions on their wills, and theme star, as limit to freedom of test content is the one concerning the legitimate.
