Se podría afirmar que, en la actualidad, ya existen invenciones patentables que han sido creadas a partir de un fenómeno conocido por Inteligencia Artificial. Este concepto engloba numerosas realidades: desde ordenadores creativos con capacidad de aprendizaje, hasta máquinas con habilidades inventivas capaces de solucionar problemas por sí mismas. Con la aparición de estos nuevos «agentes inteligentes» cabría plantearse, entre otras cuestiones, si pueden ser titulares de un derecho de exclusiva. ¿Qué ocurrirá si una máquina que emula un cerebro humano desarrolla una invención patentable? Asistimos, a un posible cambio de paradigma en el Derecho de patentes que deberá revisar sus conceptos para adaptarlos a una realidad emergente.

It may be stated that, today, there are already patentable inventions created by a phenomenon known as Artificial Intelligence. This concept encompasses many realities such as creative computers or machines provided with inventive abilities capable of solving problems on their own. As a result of the emergence of these new «intelligent agents», it could be questioned whether such machines can be holders of an exclusive right. Particularly, what would happen in a scenario where a machine that emulates a human brain develops an invention that can be considered patentable? Hence, we are witnessing a potential paradigm shift in the Patent system in order to adapt its current concepts to a still emerging reality.
