Since 1958, the Constitutional Council has been acting as electoral judge with regards to parliamentary and presidential elections. Assigning such competence to an independent jurisdiction seems to be a progess compared to the previous legal provisions. However, the decisions of the Constitutional Council regarding elections are often the target of criticisms bearing either on the field of competence of the Council with respect to the Council of State and the procedural judge, or the political nature of its control.

Depuis 1958, le Conseil constitutionnel assume les compétences de juge électoral pour les élections parlementaires et présidentielle. Cette attribution de compétence au profit d’une juridiction indépendante paraît représenter un progrès au regard du droit antérieur. Pourtant, régulièrement les décisions du Conseil constitutionnel en matière électorale sont l’objet de critiques portant soit sur le champ de ses compétences notamment par rapport au Conseil d’État et au juge judiciaire des référés, soit sur le caractère politique de son contrôle.
