    At a time when constitutional reform is on the agenda, it can be questioned whether the Constitutional Council is the only institution that could not be reformed? This institution should find a new equilibrium in the appointment of its members, a greater openness in its functioning and procedure which could come from a clarification of its relationships with administrative and judiciary magistrates. The main stake however remains the evolution of its competence given the growing influence of European Union and Council of Europe law.

    À l’heure de la réforme constitutionnelle, le Conseil constitutionnel serait-il le seul à ne pouvoir être réformé ? L’institution doit trouver un nouvel équilibre dans la désignation de ses membres, une plus grande transparence dans son fonctionnement et sa procédure, en clarifiant ses relations avec les juges administratifs et judiciaires. Mais l’enjeu principal demeure l’évolution des compétences, au regard de l’influence majeure du droit communautaire et du droit européen.
