  Avoiding ideological positioning, this papertries to determine, from a legal analyst's point of view, whether the Constitutional Council is overzealous with regards to the competences granted to it by the Constitution. An analysis of the cases which constitute an 'excessive use of constitutional power' and of those which constitute a 'denial of constitutional justice' tends to illustrate the liberties the Constitutional Council sometimes takes with the constitutional rule.

  Sans se situer sur le terrain idéologique, cet article s’attache à répondre en juriste à la question de savoir si le Conseil constitutionnel en fait trop par rapport aux compétences que la Constitution lui attribue. L’étude des jurisprudences constituant un « excès de pouvoir constitutionnel » et celles relevant du « déni de justice constitutionnelle » tend à démontrer les distances que le Conseil constitutionnel prend parfois avec la règle constitutionnelle.
