    This article deals with some relevant issues concerning the individual's right to defence. Namely, it addresses the right of a person charged with a criminal offence to defend himself in person or to have legal assistance and representation in light of the ordre public and of the fair trial principles. Further, it looks into the circumstances of the apprehension of a person charged with a criminal offence and the male captus bene detentus principle. Moreover, it analyses the ne bis in idem principle in the system of the Rome Convention of Human Rights and in that of the European Union. In particular, moving from the fact that the European Court of Human Rights is not competent to rule formally on compliance with European Union law, it looks into the question of whether there is any room to apply Art. 30 of the Vienna Convention on international treaties
