Resumen de La Sostenibilidad de la sanidad turbada por la Jurisdicción Contencioso-Administrativa

La sostenibilidad del sistema sanitario gira habitualmente en torno al reto de minimizar costes por el impacto de factores conocidos: el acicate del envejecimiento de la población, las costosas tecnologías y terapias, la inflación específica del material sanitario y de retribuciones de los profesionales de la salud o la creciente sensibilidad ciudadana demandando mayores niveles de servicio sanitario.
Sin embargo, en el sistema sanitario público concurre el mar de fondo de las consecuencias presupuestarias de los errores de gestión pública que se evidencian por sentencias condenatorias de la administración sanitaria dictadas por la jurisdicción contencioso-administrativa y cuya insalvable incertidumbre hacen tambalearse los planteamientos y previsiones presupuestarias.
Por ello se encarece que las Gerencias públicas sanitarias y las autoridades gubernativas reaccionen con su potestad de organización a la vista de las decisiones judiciales para reorientar su forma de gestión, no solo para reparar sino para prevenir.

The sustainability of the healthcare system usually revolves around the challenge of minimizing costs due to the impact of known factors: the stimulus of the aging of the population, costly technologies and therapies, (-) specific inflation of health equipment and the remuneration of health professionals or the growing citizen sensitivity demanding higher levels of health service.
However, in the public health system there is the background sea of the budgetary consequences of errors in public management that are permeated by convictions of the health administration issued by the contentious-administrative jurisdiction and whose insurmountable uncertainty sends budgetary forecasts and approaches into a tailspin.
Therefore it is necessary that public health managers and governmental authorities should react with their organiza- tional power in view of judicial decisions to reconceptualize their management, not only to repair but also to prevent.
