El presente trabajo pretende abordar un particular aspecto dentro del régimen jurídico del contrato de servicios, cual es la determinación del precio a falta de pacto entre las partes. Nuestro Código civil limita expresamente la posibilidad de concluir un contrato incompleto por indeterminación del objeto, exigiendo con ello la certeza del precio o la fijación de los criterios para su cuantificación como requisito de validez del contrato. Ello no obstante, la jurisprudencia española hace ya tiempo que se desmarca abiertamente de la rigidez de nuestro Código, acogiendo un sistema más flexible que trata de salvar al contrato frente a la indeterminación del precio. Y en esta misma línea, mucho más acorde con la realidad actual, los principales textos armonizadores del Derecho contractual, de ámbito internacional y europeo, prescinden como requisito esencial para la validez del contrato de la determinación o determinabilidad del precio, optando por un sistema de precio abierto o indeterminado, conocido como open price contract.

The present work aims to address a particular aspect within the legal regime of the service contract, which is the determination of the price in the absence of agreement between the parties. Our Civil Code expressly limits the possibility of concluding an incomplete contract due to the indetermination of the object, thereby requiring the certainty of the price or the determination of the criteria for quantification as a requirement for the validity of the contract. Nevertheless, Spanish jurisprudence has long since unchecked the rigidity of our Code, accepting a more flexible system that tries to save the contract against price indeterminacy. And in this same line, much more aligned with current reality, the main harmonizing texts of contract law, within the international and European frame, do without the determination or determinability of the price as an essential requirement for the validity of the contract, opting for a system of open or indeterminate price, known as open price contract.
