The subject of this research is the legal action of the procedural protection provided in Ulp. 66 ad ed. D. 42.8.1 pr. The focus is on the interpretation of the periphrasis "curatori bonorum vel ei, cui de ea re actionem dare oportebit" which can be found in the edict, indicating people to whom the judge can give the action for the deed’s repeal "in fraudem creditorum". With proper precautions, it is conjectured that the convoluted expression, starting from "vel", had been added by Justinian’s Commissioners to count in this edict’s protection the revocation of fraudulent acts committed before the "missio in bona " as well, therefore before the curator’s nomination. The Compilers adding “vel ei, cui de ea re actionem dare oportebit”, chose the deliberately vague sentence, which even if in theory could admit of several interpretations, virtually didn’t cause big troble, because the "missio in bona"wasn’t used since a long time.

La ricerca esamina il tema della legitimazione attiva della tutela processuale prevista in Ulp. 66 ad ed. D. 42.8.1 pr. ed è centrata sull'interpretazione della perifrasi "curatori bonorum vel ei, cui de ea re actionem dare oportebit" presente nell’editto per indicare i soggetti ai quali il pretore può concederé l’azione per la revoca degli atti “in fraudem creditorum”. Con le dovute cautele, viene avanzata la congettura che l’involuta espressione, a partire da “vel”, sia stata aggiunta dai commissari di Giustiniano per ricomprendere nella tutela di questo editto anche la revoca di atti fraudolenti posti in essere prime della “missio in bona”, e quindi anteriormente alla nomina del curatore. I Compilatori, aggiugendo “vel ei, cui de ea re actionem dare oportebit", optarono per una frase volutamente vaga, che sebbene in teoría poteva dare adito a più letture, nella pratica non creava grandi problema in quanto da molto tempo non si faceva più ricorso alla “missio in bona”.
