Resumen de La terra e il tempo: Per una discussione attorno a lavoro e forme giuridiche fra antichità medioevo

Emanuele Stolfi

  • This paper focuses on some legal apects of work (specially agricultural) in Roman Republic and Principate, with regard to ancient solutions and their interpretations in the following legal history. The author analyzes the great distance between meaning of Roman jurists and modern ideas of work: a diference not only conceptual and technical, but also anthropological. Exactly in this perspective the land has a basic role (the real "workshop of ancient man"), and the economic and legal order is influenced by the time in a double sense, as change of seasons and as long duration. From the first point of view, this article examines mostly the combination of slave and free labour; from the secind, history and rules of legal institutions as "locatio in perpetuum" and "emphyteusis"
