Mientras el contrato de hospedaje permanece en el Derecho español como un contrato atípico, el Código civil cubano de 1987 lo regula en los artículos 438 a 443. Esta regulación, a primera vista, está marcada por dos claves: de una parte, refleja las exigencias políticas y económicas propias de la República cubana, de otra, un número muy reducido de artículos resuelve una cuestión ciertamente compleja, lo que se explica en un Código de tan solo 547 preceptos. Ello no impide, sin embargo, que su regulación pueda ser ahora el referente para el Código civil español. La opción del legislador cubano pasa por dejar fuera del Código civil la labor realizada por los cuentapropistas en sus domicilios lo que, a su vez, puede guardar también una cierta identidad con un fenómeno en auge, el de las viviendas en España destinadas al turismo. En estas páginas hemos pretendido dar una completa visión del contrato de hospedaje en Cuba a través del análisis de cada uno de los preceptos que lo regula.
While the accommodation contract remains in Spanish law as an atypical contract, the Cuban Civil Code of 1987 regulates it in articles 438 to 443. This regulation, at first sight, is marked by two key parts: on the one hand, it reflects the requirements of the political and economic policies of the Cuban Republic, on the other hand, a very small number of articles resolves a certainly complex question, which is explained in a Code of only 547 precepts. This does not prevent, however, that its regulation can now be the reference for the Spanish Civil Code. The option of the Cuban legislator is to leave out of the Civil Code the work done by the «cuentapropistas» in their homes which, in turn, can also keep a certain identity with a phenomenon on the rise, that of homes in Spain designated for tourism. In these pages we have tried to give a complete vision of the hosting contract in Cuba through the analysis of each of the precepts that regulate it.
