Principio, realidad y norma: la necesidad de su sincretismo tridimencional, a través de un iusnaturalismo «constitucionalizado», como método de investigación iusprivatista

    Frente a la actitud radicalmente positivista que, actualmente, se vuelve a manifestar en buena parte de la doctrina jurídica, que incurre de nuevo en el culto al texto de la ley, en este trabajo, su autor reivindica un retorno al iusnaturalismo, aunque actualizado, no irreal, ni ahistórico, sino atento a la realidad social vigente y a la propia norma positiva; tampoco se trataría de un iusnaturalismo teológico, de tinte religioso, sino inspirado en los propios principios y valores jurídicos que, en parte, los textos constitucionales e internacionales sobre la persona consagran en un necesario, pero no fácil, equilibrio entre la seguridad y la justicia.

    Faced with the radically positivist attitude that currently manifests itself in much of the legal doctrine, which incurs again in the cult of the text of the law, in this work, its author claims a return to natural law, although updated, not unreal, not ahistorical, but attentive to the current social reality and to the positive norm itself; nor would it be a teological iusnaturalism, of religious overtones, but inspired by the very principles and legal values that, in part, the constitutional and international texts on the person consecrate in a necessary, but not easy, balance between security and justice.
