The purpose of this paper is to examine some of the patrimonial precautionary measures that may be agreed to prior to the issuance of the declaration of bankruptcy, and always upon the request of a legitimate, interested party. Although it is not possible to adopt such measures ex officio, the paper explores the possibility of the bankruptcy judge, rather than implementing those measures initially requested, eventually ordering different measures or, if appropriate, substituting those initially ordered for other measures. The author also studies the debtor’s potential options to oppose such protective measures. Fundamentally, the paper analyzes injunctive measures, consisting of the suspension of foreclosures, both ordinaries and of security interests, and of seizures-sequestrations, with reference to such measures» arising and their subsequent cancellation, as well as those of a preventive nature.
