Resumen de La administración concursal en la propuesta de Real Decreto Legislativo por el que se aprueba el Texto Refundido de la Ley Concursal

En los 14 años transcurridos desde la entrada en vigor de la Ley Concursal, la figura de la Administración Concursal se ha mostrado como parte fundamental del mecanismo del sistema de insolvencia en nuestro país. Y es que la Ley ha considerado al Juez y a la Administración Concursal como los únicos órganos necesarios en el procedimiento concursal, dotando a esta última de importantes funciones que la convierten en la pieza esencial de la gestión del patrimonio insolvente.Como consecuencia de todo ello, resulta fundamental comprobar si su importancia se ve también trasladada en la nueva Propuesta de Real Decreto Legislativo por el que se aprueba el Texto Refundido de la Ley Concursal, así como estudiar las modificaciones que afectan a la misma, todo ello de cara a tener presente la nueva regulación que va a presidir la actuación de ésta en el supuesto que la propuesta emanada de la Comisión General de Codificación termine recibiendo el necesario respaldo parlamentario.

n 14 years passed from the entry into force of the Bankruptcy Act, the figure of the Bankruptcy administration has appeared as fundamental part of the mechanism of the system of insolvency in our country. And it is that the Law has considered to be the Judge and the Bankruptcy administration the only necessary organs in the procedure concursal, providing the latter with important functions that turn her into the essential piece of the management of the insolvent heritage.As consequence of all this, it turns out to be fundamental to verify if his importance meets also moved in the new proposed of Legislative Royal decree by which there is approved the consolidated Text of the Bankruptcy Act, as well as to study the modifications that affect the same one, all this in order to bear in mind the new regulation that is going to preside at the action of this one in the supposition that the offer come from the General Commission of Codification ends up by receiving the necessary parliamentary support.
