Impacto ocasionado en el control de calidad por la sentencia del Tribunal Supremo contra la Instrucción de hormigón estructural EHE-08

    Los Distintivos de Calidad Voluntarios Oficialmente Reconocidos son una piedra angular que afecta a todos los productos relacionados con la EHE-08. La redacción de dicha Instrucción, al no considerar los Reglamentos Europeos, supone un obstáculo para la libre circulación de mercancías , que es uno de los pilares básicos de la UE.

    La Sentencia de 27 de Septiembre de 2012 del Tribunal Supremo por la que se declaran nulos los párrafos séptimo y octavo del Artículo 81 y todo el Anejo 19 de la Instrucción de Hormigón Estructural ( EHE-08 ) abre un período de incertidumbre en todo lo relacionado con la calidad de los materiales empleados en las obras , sean públicas o privadas .

    Dicha Sentencia, amparada por pronunciamientos del Tribunal de Justicia de la Unión Europea , incide directamente en los Distintivos de Calidad Voluntarios ( figura que cruza diagonalmente toda la Instrucción tanto en aspectos de calidad de materiales como aspectos técnicos , coeficientes de seguridad , etc ) y en el obstáculo al principio de libre circulación de mercancías dentro de la Unión Europea que la EHE-08 ha generado. Ello implica, inevitablemente , una restricción a la libre competencia con las consecuencias , de todo género , que ello ocasiona.

    En la presente comunicación se detallan , en lenguaje jurídico-técnico , las claves de dicha Sentencia , su motivación y desarrollo , así como su efecto inmediato en todos los actores del sector de la construcción ( Proyectistas , Promotores , Constructoras , Fabricantes , Organismos de Control , etc ) . Asimismo, en base a dicha Sentencia y a la regulación de la UE, se detallan los problemas principales y se apunta cual será el panorama legislativo para los próximos años.

    The Quality Volunteers Distinctives Officially Recognized are main elements that affects all products related to EHE-08. The redaction of the Instruction, by not considering the European Regulations, is an obstacle to the free movement of goods, which is one of the pillars of the EU.

    The Judicial Sentence of September 27, 2012 , of the Spanish Supreme Court declaring nulls the seventh and eighth paragraphs of Article 81 and all the Annex 19 of the Reinforced Concrete Normative (EHE-08), opens a period of uncertainty in all aspects with the quality of the materials used in the constructions, whether public or private.

    This Sentence, supported by pronouncements of the Court of Justice of the European Union, directly affects the Quality Volunteers Distinctive (figure that diagonally across all aspects of the Normative either in quality of materials or in technical aspects, such as safety factors, etc.) and the obstacle to the free movement of goods within the European Union that EHE-08 has generated. This inevitably involves a restriction to free competence with the consequences, of every kind, that it causes.

    In the present submission the keys of the Sentence are detailed, in technical/legal language, as well as the immediate effects above all actors of the construction sector (Designers, Developers, Builders, Manufacturers , Quality Control , etc). Furthermore, based on this Sentence and EU regulations, the main problems are detailed and pointed out which will be the legislative scene for the coming years.
