Resumen de La figura del Condohotel en la normativa autonómica

En este artículo se aborda la normativa autonómica española sobre el condohotel. Al carecer a nivel estatal de una regulación propia, esta modalidad de explotación hotelera presenta una elevada complejidad respecto al régimen jurídico aplicable. La evolución que ha sufrido la figura en el mercado hotelero americano con las conocidas private residences, es contraria a la lentitud con la que se incorpora en nuestro ordenamiento. Esto ha originado que algunos legisladores autonómicos hayan intentado regular esta figura, lo que ha puesto de manifiesto la necesidad de ofrecer mayor protección a las relaciones privadas entre los propietarios y la entidad explotadora, ofrecer seguridad a los turistas que reservan las unidades de alojamiento turístico y prestar atención sobre los reglamentos internos y las reglas y restricciones de uso.

This paper examines the condohotel’s regional regulation in Spain. There is no national autonomous regulation, that’s causes a high complexity to know what rules apply. The ever-growing evolution that has suffered this kind of hotel management on the American hotel market with the private residences system, it is opposite to the slowness we incorporate it into our legal system. Some regional regulation have regulated this figure, which has revealed the need to offer major protection to the relations between the owners and the hotel chain, offer safety to the tourists who make a hotel reservation and pay attention to the condo bylaws and the usage rules and restrictions.
