    Se planteará la defensa del derecho de propiedad frente a la ocupación sin titulo. Acción a ejercitar, vía penal y fundamentalmente civil mediante protección posesoria ejercitando acción hipotecaria (artículo 41 de la Ley Hipotecaria) y de desahucio por precario. Reforma legal operada por la Ley 5/2018, de 11 de junio, de modificación de la Ley 1/2000, de 7 de enero de Enjuiciamiento Civil, en relación a la ocupación ilegal de viviendas. Posible discriminación cuando la titularidad la ostente una persona jurídica.
