La sentencia de incapacitación carece de efectos retroactivos o «ex tunc», siendo aplicable con carácter previo a su firmeza la presunción de capacidad del sujeto ya incapacitado. De ahí que la declaración de incapacitación del testador posterior a la fecha de otorgamiento del testamento no sea prueba determinante, por sí sola, de su falta de capacidad para testar. Mas ello no obsta a la posibilidad de anulación del testamento, a instancia de parte interesada, por falta de la capacidad legal necesaria al efecto del causante, que deberá demostrarse de modo concluyente, pues en caso contrario resultará aplicable el principio del favor testamenti en conexión con la presunción de capacidad del testador en orden a la validez y eficacia del testamento otorgado.
