De acuerdo con el artículo 101 del Código civil la pensión compensatoria se extingue por ulterior matrimonio de su beneficiario con un tercero. La extinción se produce, según la solución más acorde con el espíritu del citado precepto, en el instante mismo en que concurre el supuesto de hecho previsto, es decir, al tiempo de la celebración del enlace matrimonial. Existiendo datos objetivos que permitan el establecimiento de una fecha indubitada, nada debería impedir que se señale la misma como fecha de extinción. Por lo tanto, probada la causa extintiva y acreditada la fecha de su concurrencia, la extinción del derecho a la pensión podrá retrotraer sus efectos, si así se solicita (principio de justicia rogada), a dicho momento
