Encarcelamiento en Chile.: Necesidad de una nueva regulación a nivel constitucional

    Acentuando las estructuras económicas desiguales y la exclusión, el encarcelamiento masivo crece como complemento a la inexistencia de un Estado social. Igualmente, la politización del problema de la delincuencia alimenta el populismo punitivo que termina traduciéndose en un aumento del encarcelamiento hasta niveles sin precedentes.

    El actual y necesario debate de una Constitución legítima para Chile no debe olvidar la dignidad de los presos y en ese sentido deben establecerse límites al poder estatal que garanticen el respeto de la dignidad humana.

    Este trabajo plantea algunas ideas de una Constitución respetuosa de los derechos humanos y que, en vez de fomentar la segregación y el encierro de los más pobres y marginados, tienda a la integración y al fortalecimiento del Estado social.

    By accentuating unequal economic structures and exclusion, mass imprisonment is growing as a complement to the absence of a social state. The politicization of the crime problem also fuels punitive populism, which in the end leads to an increase in imprisonment to much higher levels than those of the dictatorship. The current and necessary debate on a legitimate Constitution for Chile must not forget the dignity of the prisoners and, in this regard, limits must be established on the power of the State that guarantee or tend to guarantee respect for human dignity. This paper puts forward some ideas fora Constitution that respects human rights and that, instead of promoting the segregation and confinement of the poorest and most marginalised, aims to integrate and strengthen the social state.
