Resumen de Walter Benjamin: una crítica a la violencia del derecho

Este artículo pretende exponer la relación de la violencia con el derecho desde los aportes de Walter Benjamin en su ensayo titulado Para una crítica de la violencia (Zur Kritik der Gewalt, 1921). Benjamin no sólo juzga los criterios de aplicación de la violencia jurídica, sino que avanza a la crítica del derecho positivo mismo, dada su íntima y compleja relación con la violencia. Por supuesto, el autor no encuentra este fundamento crítico en la concepción iusnaturalista, ni en la iuspositivista, sino en la histórico-filosófica del derecho, en la cual localiza definitivamente su crítica. Este ensayo nos permite analizar el fundamento de poder, fuerza y autoridad que, de un lado, funda y conserva la ficción jurídica, y de otro lado, le permite al derecho disponer legítimamente de la vida, al punto de suprimirla. Entre los resultados que arroja la investigación benjaminiana, se encuentra la admisión de otras formas de organización inaccesibles a la violencia del derecho o del Estado, esto es, aquéllas basadas en la “cultura del corazón”.

This article aims to clarify the relationship of violence to the right from the contributions of Walter Benjamin in his essay entitled for a critique of violence (Gewalt der Zur Kritik, 1921). Benjamin not only judges the criteria for application of legal violence, but advances to the critique of positive law itself, given its intimate and complex relationship with violence. Of course, the author not found this critical foundation in the conception of natural law, or the positivist law, but in the historical and philosophical of law, which definitely locates his critique. This test allows us to analyze the foundation of power, strength and authority which, on the one hand; he founded and maintains the legal fiction, and on the other hand, lets you legitimately have the right of life, to the point of abolishing it. Among the results that research Benjamin, is the admission of other forms of organization inaccessible to violence or State law, namely those based on the “culture of heart.”
