Resumen de Abriendo la caja negra del conocimiento jurídico: Elementos para una reconstrucción de las decisiones judiciales

El pensamiento racional moderno ha venido considerando que los procesos de interpretación y aplicación del Derecho que se llevan a cabo para resolver un caso son operaciones racionales. Sin embargo, si tenemos en cuenta el tipo de actividades que se desarrollan en la práctica forense cotidiana y las reglas que la rigen, se llega a la conclusión de que no estamos ante un proceso tan racional como se supone. Pero tratar de ofrecer pautas para hacer más racional esa decisión pasa por conocer hasta qué punto no lo es ahora. Desde mediados del siglo xx se cuentan con nuevas metodologías que han surgido tras la crítica a la teoría moderna del conocimiento, que lo situaba en una torre de marfil, ajeno a las influencias del medio social y natural sobre el sujeto que conoce. Estas otras metodologías prestan atención a la manera en que se llevan a cabo cierto tipo de operaciones mentales o se toman cierto tipo de decisiones que suelen pasar desapercibidas. Persiguen desvelar, en definitiva, la caja negra del conocimiento. Este artículo se dirige a mostrar su posible uso en el conocimiento de la caja negra de los procesos que hay tras la decisión judicial que resuelve el caso.

The modern rational thought has considered that the interpretation and application of law in order to resolve cases are rational operations. However, if we consider the type of activities that takes place in everyday court practices and the rules governing them, we come to the conclusion that this is not a rational process such as assumed. But if we try to offer guidelines to make the court decision more rational, we need to know to what extent it is not now. Since the mid-twentieth century it is possible to count on new methodologies that have emerged after the criticism of the modern theory of knowledge, which had placed it into an ivory tower, forgetting the influences of social and natural environment on the individual that knows. These other methodologies pay attention to how some type of mental operations is carried out or how certain types of decisions are adopted, which usually is unnoticed. They intend to reveal, ultimately, the black box of knowledge. This article aims to show their possible utilization in understanding the black box of knowledge behind the court decision that solves the case.
