  El presente trabajo de investigación tiene como objetivo realizar un análisis exhaustivo sobre el financiamiento del seguro de desempleo frente al fondo de cesantía y los derechos constitucionales para los afiliados. La Ley Orgánica para la Optimización de la Jornada Laboral y Seguro de Desempleo de forma ligera fue aprobada sin considerar que el desempleo que enfrenta el Ecuador como problema social producido por la situación económica del país, lo que se ha pretendido es que con la aprobación de normativa económica urgente el Estado se deslinde de la obligación de continuar protegiendo los derechos de todos los ciudadanos, especialmente en este caso de los afiliados. Frente a este problema normativo se creó el documento de análisis crítico jurídico para evidenciar la importancia que tiene el Estado como tal en los derechos de los afiliados, que aunque sabemos que el Instituto Ecuatoriano de Seguridad Social vive por las aportaciones particulares de cada ciudadano, es obligación del Estado ecuatoriano velar por la protección integral del derecho de la seguridad social.

  The objective of this research is to carry out an exhaustive analysis on the financing of unemployment insurance against the unemployment fund and the constitutional rights for members. The Organic Law for the Optimization of the Labor Day and Unemployment Insurance in a light way was approved without considering that the unemployment that Ecuador faces as a social problem produced by the economic situation of the country, what has been pretended is that with the approval of urgent economic regulation the State deviates from the obligation to continue protecting the rights of all citizens, especially in this case of affiliates. Faced with this normative problem, the legal critical analysis document was created to demonstrate the importance of the State as such in the rights of the affiliates, which although we know that the Ecuadorian Social Security Institute lives by the particular contributions of each citizen, is obligation of the Ecuadorian State to ensure full protection of the right to social security.
