Este trabajo analiza la controversia competencial planteada en relación a la regulación realizada tanto por el legislador navarro como por el legislador aragonés en torno a los bienes vacantes. Son dos las cuestiones troncales debatidas: cuál es la materia que subyace en la atribución por Ley de títulos vacantes y, en consecuencia, el título competencial específico aplicable a la controversia planteada; y en segundo lugar, el alcance del título competencial «desarrollo» autonómico del Derecho civil especial o foral; especialmente, se trata de analizar la necesaria conexión material entre la concreta regulación y una institución civil preexistente en el Derecho civil foral o especial.
This paper analyzes the competence controversy raised in relation to the regulation carried out by the Aragonese and Navarre legislator around bona vacantia. They are two the main debated questions: what is the matter that underlies in the attribution by Law of bona vacantia and, consequently, the specific competence title applicable to the controversy raised; and secondly, there discusses the scope of the regional «development» competency title of the special or foral civil law; and, especially, it is about analyzing the necessary material connection between the concrete regulation and a preexisting civil institution in the special or foral civil law.
