Resumen de Prostitución y ordenanzas cívicas:: De regular "sobre" a regular "con"

  Este artículo analiza los diferentes posicionamientos ideológicos existentes en relación al tratamiento de la prostitución y su incidencia en los ordenamientos jurídicos y en las personas que ejercen la prostitución. Asimismo, se analiza el modelo vigente en España y las diferentes estrategias que los poderes públicos han adoptado frente a la prostitución según sean de ámbito estatal, autonómico y local, centrándonos en la regulación promovida por las ordenanzas cívicas y su proyección a nivel social y jurídico. A modo de conclusión, nos cuestionamos el sistema actual y proponemos el empoderamiento de dicho colectivo a través de las reformas introducidas por la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, en cuanto a la elaboración de los reglamentos y su necesidad de participación ciudadana, conllevando un cambio de paradigma, para pasar de regular “sobre” ellas a regular “con” ellas.

  This article analyses the different ideological positions that exist in relation to the approach to prostitution and its incidence in legal systems and in persons who practice prostitution. Likewise, the current model in Spain and the different strategies that the public authorities have adopted against prostitution are analysed, depending on whether they are state, autonomous or local subjects, focusing on the regulation promoted by civic ordinances and their social and legal projection. By way of conclusion, we question the current system in order to propose the empowerment of this group through the reforms introduced by Law 39/2015, of October the 1st, about the Common Administrative Procedure of Public Administrations, regarding the preparation of it regulations and their need for citizen participation, leading to a paradigm shift, to go to regulate "with" them instead of to regulate "over" them.
