La ley portuguesa 25/2016 vino a regular lo que el Tribunal Constitucional luso denomina el «modelo portugués de gestación de sustitución». Tras la autorización de apenas dos supuestos de gestación subrogada, el Acórdão 225/2018 viene a mutar sustancialmente dicho modelo, sometiéndolo a un estricto control de ajuste al principio de respeto a la dignidad humana, con especial atención a la proyección de dicho principio sobre la persona de la mujer gestante. Queda por determinar si la mutación jurisprudencial forzará una próxima modificación normativa o si, sencillamente, el sistema quedará inhabilitado como consecuencia de las dificultades asociadas a los límites impuestos por el Tribunal Constitucional al legislador.

Portuguese Act 25/2016 regulates what the Portuguese Constitutional Court has come to call the «gestational surrogacy model». After the authorisation of just two assumptions of surrogate pregnancy, the Acórdão 225/2018 has substantially changed this model, subjecting it to strict control of adjustment to the principle of respect for human dignity, with particular attention to the projection of said principle on the person of the pregnant woman. It remains to be determined if that case-law mutation will force an upcoming legal amendment or if the system will just be disqualified as a consequence of the difficulties associated with the limits imposed by the Constitutional Court on the legislator.
