Portabilidad transfronteriza de contenidos digitales en la Unión Europea

    El actual bloqueo geográfico al acceso y al uso de contenidos en línea protegidos por derechos de autor cuando el usuario está temporalmente en un Estado miembro que no es el de su residencia, desde el 1 de abril de 2018, forma parte de la historia del proyecto de integración europeo. El Reglamento (UE) 2017/1128 relativo a la portabilidad de los servicios de contenidos en línea en el mercado interior resuelve el problema de la portabilidad transfronteriza de contenidos digitales protegidos por derechos de autor; aunque la naturaleza técnica utilizada en algunos de sus preceptos puede afectar al alcance y a la efectividad del propio Reglamento, así como al derecho del titular del contenido digital protegido, en la medida en que la utilización de la excepción obligatoria creada en la norma puede no superar la regla de los tres pasos.

    The current geographical blockade to access and use of online content protected by copyright when the user is temporarily in a different Member State, from April 1, 2018, is part of the history of the European integration project. Regulation (EU) 2017/1128 on the portability of online content services in the internal market solves the problem of cross-border portability of digital content protected by copyright; although the technical nature used in some of its precepts may affect the scope and effectiveness of the Regulation itself, as well as the right of the owner of the protected digital content, to the extent that the use of the mandatory exception created in the standard may not exceed the rule of the three steps.
