    En el presente estudio pretendemos señalar la novedad que Alfonso de Castro introduce en su pensamiento sobre la ley humana a partir de su lectura de la tradición franciscana, especialmente de Duns Escoto. El contexto es el del descubrimiento del Nuevo Mundo americano y de la instauración de un Mundo Nuevo de la Modernidad. Para ello insiste en la libertad fundamental del ser humano reflejo e imagen de Dios, en su entendimiento pero sobre todo en su voluntad, como elemento propio en la promulgación de las leyes de los hombres.

    The scope of the present paper is to point out the novelty that Alfonso de Castro introduces in his thinking about human law from his reading of the Franciscan tradition, especially of Duns Scotus. The context is that of the discovery of the New (American) World and the establishment of a New World of Modernity. For this he insists on the fundamental freedom of the human being, reflection and image of God, in his understanding but above all in his will, as an element in the promulgation of the laws of men.
