    A existência da Propriedade Industrial tem como fundamento a concessão de um direito de exclusividade ao titular de uma nova tecnologia, condicionando-se está diretamente à divulgação do modus operandi deste, ou seja, do segredo existente no invento. O trabalho objetiva analisar como o instituto da proteção de cultivares pode influenciar o desenvolvimento tecnológico de um setor do agronegócio: o caso específico da cadeia do arroz. O trabalho analisa de maneira geral os fundamentos da proteção da Propriedade Industrial, para verificar se, no caso concreto, estes se mostram efetivamente realizáveis. Aplica-se o método hipotético dedutivo, no qual se propõe como hipótese a assertiva de que a proteção dos DPI aplicados às plantas pode promover o desenvolvimento de novas tecnologias e que isso resulta em benefícios para os stakeholders e para a sociedade.

    The existence of industrial property is based on the grant of an exclusive right to the holder of a new technology, conditioning themselves is directly to the disclosure of the modus operandi of this, that is, the existing secret in the invention. The study aims to analyze how the cultivar protection Institute can influence the technological development of the agribusiness sector: the specific case of rice chain. The paper analyzes in general the fundamentals of protection of Industrial Property, to check whether, in this case, these are shown effectively achievable. It applies the hypothetical deductive method, which is proposed as a hypothesis the assertion that the protection of IPRs applied to plants can promote the development of new technologies and that this results in benefits for stakeholders and society.
