35 LGT.
This paper analyses the classification of the Spanish tax fraud crime regulated in the art. 305 CP as a special crime or a common crime, also the consequent delimitation of the circle of possible authors. For this purpose, a systematization of the existing opinions in the Spanish literature is carried out. In addition, I propose an interpretation de lege lata of the art. 305 CP that leads to affirm that only the taxpayer and the retainer can be responsible as an author. Finally, I analyse which agents remain outside of the circle of possible authors.
