Breves reflexiones acerca del papel del amor en el matrimonio del derecho romano

    Muchas son las obras que, en sede romanística, han versado sobre el tema del matrimonio romano. Sin embargo, ninguna de ellos ha tenido por objeto el estudio del papel de amor en esta institución tan fundamental para la persona y la sociedad de cualquier tiempo. En este artículo comenzaremos por aproximarnos a la quaestio amor, estudiando su concepto y las diferentes formas o manifestaciones que existen del amor. A continuación, trataremos de averiguar qué concepto de amor existió en Roma y si tuvo un peso específico en la institución jurídica matrimonial. Ello lo haremos a través del estudio directo de las fuentes: literarias (poetas elegiacos y satíricos), epigráficas (la Laudatio Turiae) y jurídicas, incluyendo en estas últimas tanto las dos definiciones que se conservan del matrimonio como una selección de textos del Digesto en los que se hace mención del amor. Por último, finalizaremos con unas conclusiones.

    The subject of roman marriage has been widely addressed in the field of roman law. However, references dealing with the role of love within marriage, essential both to the person and the society at any given stage in history, have not been identified. The present paper opens with an approximation to the ‘quaestio amor’, and its manifestations in different forms. Following, we will attempt to determine what was understood as love in Rome, and whether it had a special relevance to the legal institution of marriage. Such an analysis will be carried out through direct study of the sources: literary sources (elegiac and satiric poets), epigraphic sources (the ‘Laudatio Turiae’) and legal sources. The latter will include the two remaining definitions of marriage as well as a text selection from the Digesto in which love is mentioned. Finally, conclusions will be drawn from this study.
