  Cuando expira el mandato de representantes sindicales y aún no se han celebrado las elecciones se prorroga aquél de forma automática. Ahora bien, surge la duda de si tienen capacidad o no para la negociación colectiva en nombre de los sindicatos más representativos a los que representan a tenor de la Disposición adicional 4ª de la Ley Orgánica de Libertad Sindical, tanto en el ámbito privado como en el de la función pública.

  When the mandate of union representatives expires and the elections have not yet been held, it is automatically extended. However, the question arises as to whether or not they have the capacity for collective bargaining power on behalf of the most representative trade unions they represent, in accordance with Additional Provision 4 of the Organic Law on Freedom of Association, both in the private sector and in the public function.
