  This work aims to reflect on the legal-political future constituted in the modernity in hyperbolic times, beginning with the analysis of the general and common elements of Modern States, from its historical origin and its intimate relationship with capitalism as an economic system, democratic states of law, precisely because of the economic independence of the capitalist system. It is not denied that there is an attempt to break "umbilical" and this will happen, sooner or later, with the possibility of adopting a new economic system, still in gestation, but already has signs of its transition, which occurs slowly , but gradually. This rupture, however, can not be only local, but it must occur globally, because its symptoms are international and the solutions for the polycrisis already present themselves, simply by having their points of attachment happen. Perhaps this is the new political-juridical function, in times that refuse to become hopeless. Here's the challenge: to overcome this mystery.

  Este trabalho tem como escopo refletir sobre o futuro jurídico-político constituído na modernidade em tempos hiperbólicos, iniciando pela análise dos elementos gerais e comuns dos Estados Modernos, desde sua origem histórica e sua íntima relação com o capitalismo enquanto sistema econômico, passando pelas promessas não cumpridas dos Estados Democráticos de Direito, justamente pela ainda não independência econômica do sistema capitalista. Não se nega que há uma tentativa de rompimento “umbilical” e isto ocorrerá, mais cedo ou mais tarde, com a possibilidade de adoção de um novo sistema econômico, ainda em gestação, mas que já se tem sinais de sua transição, que ocorre lenta, mas gradualmente.

  Esta ruptura, contudo, não poderá ser apenas local, mas impõe-se que ocorra globalmente, pois seus sintomas são internacionais e as soluções para a policrise já se apresentam, bastando apenas que seus pontos de ligação aconteçam. Talvez esta seja a nova função político-jurídica, em tempos que se recusam a se tornar sem esperança. Eis o desafio: superar esta incógnita.
