La moderna esclavitud y los trabajos forzados: una mirada desde el derecho internacional actual y su (i)neficacia

    El presente trabajo trata de abordar una práctica que por similitud a la esclavitud es denominada la “esclavitud moderna” lo que se realiza, partiendo de los antecedentes históricos, desde la normativa surgida de la Organización Internacional del Trabajo, de Naciones Unidas y de los cuerpos normativos de protección de los derechos humanos, estudiando su calificación como crimen internacional y su operatividad. Asimismo, y dada la enorme importancia del actuar de las grandes empresas se hace referencia a los más actuales instrumentos que tratan de regular -débilmente- la práctica de esas, a fin de que acomoden su actividad hacia el respeto de los derechos humanos al quedar herida la dignidad de la persona mediante esta deleznable práctica de los trabajos forzados: parece evidente el aumento del mismo y la necesidad de establecer un verdadero mecanismo eficaz de lucha contra las nuevas facetas en que el mismo se manifiesta.

    This paper tries to approach a practice that, by similarity to the slavery, is denominated the "modern slavery", that what it is studied starting from the historical backgrounds. It highlights the normative emerged from the International Labour Organization, the United Nations and the texts of protection of human rights, studying as well, its qualification as an international crime and its real effectiveness.

    Likewise, and given the enormous importance of the actions of the big companies, a reference is made to the most recent instruments that try to regulate their practice in order to accommodate their activity to the respect of the human rights, due the fact that the dignity of the human being through this despicable practice of forced labor is vulnerated. It seems evident its increase and the necessity to establish a true effective mechanism of fight against the new forms in which it manifests itself.
