Resumen de Entre la revolución y la ilusión. La regulación jurídico-penal del sexo como campo de batalla

El artículo presenta una interpretación del sentido que cabe atribuir a ciertas modificaciones operadas en el derecho penal sexual en las últimas décadas. Algunas de esas variaciones han respondido a reformas legislativas y otras a pronunciamientos de los tribunales, y todas han sido objeto de una muy prolija atención por parte de los autores. La comprensión de la violación, por una parte, y de los distintos delitos relativos a la pornografía infanto-juvenil, por la otra, ofrece un buen campo de análisis del talante de estas modificaciones, y en esa medida son aquí revisados. Se sostiene que, contra lo que ha formulado un sector importante de los autores, no se ha producido una revolución legislativa y, antes bien, en el plano del derecho penal sexual se han superpuesto distintas clases de ilusiones y espejismos. Esta percepción supone reconocer, a su turno, que media una distancia entre las estructuras profundas que subyacen a las disposiciones legales y los discursos que se han venido construyendo a su alero.

The article presents an interpretation of the meaning that might be attributed to certain modifications that have taken place in the area of sexual criminal law in the last decades. Some of those variations correspond to legislative reforms and others to judicial decisions, and all of them have received very close attention from the scholars. The understanding of rape, on one hand, and of the different criminal offenses related to child and juvenile pornography, on the other, offer a good field of analysis of the character of these modifications, and in such a way they are here revised. The article, against what an important sector of the scholars have stated, argues that a legislative revolution has not taken place and that, actually, in the field of sexual criminal offenses, a series of illusions have been overlapped. On its turn, this reading entails to recognize that there is a gap between the deep structures that underlie the legal regulation and the discourses that have been construed about it.
