Desde el ámbito del derecho internacional de la cultura, el patrimonio cultural se protege de la privación ilícita, deterioro y destrucción de los bienes culturales de los Estados, ya sea por particulares o por los propios Estados. Sin embargo esta protección debe fortalecerse con otros marcos jurídicos como los de los derechos humanos, el derecho internacional público, y el derecho a la cultura.
El menoscabo al patrimonio cultural de los Estados en América incide en los pueblos indígenas debido a la riqueza ancestral material e inmaterial que aportan al propio Estado en que residen y al patrimonio común de la humanidad. Es por ello que requiere tratarlo para reforzarlo y hacer realidad el derecho humano a la cultura y derechos conexos de los pueblos indígenas.
From the scope of the international law on culture, the cultural heritage is protected from the illegal deprivation, deterioration and destruction of cultural property of States, whether by individuals or by States themselves. However this protection must be strengthened with other legal frameworks like those of human rights, public international law or the right to culture.
The erosion of the cultural heritage of the States in America affects the indigenous peoples due to the ancestral material and immaterial wealth that they contribute to the State in which they reside and to the common heritage of humanity. This cultural heritage needs to be reinforced and developed to a human right to culture related to the rights of indigenous peoples.
