  El margen de apreciación nacional se crea con el propósito de encontrar una relación más satisfactoria entre los órganos supranacionales y las autoridades del Estado, en la que se otorgue cierta libertad de configuración o deferencia de parte de la jurisdicción internacional a alguno de los poderes estatales. Aparece en el sistema europeo de protección de los derechos humanos, citándose en diversas resoluciones. Por otro parte, desde un punto de vista comparativo, en el sistema Interamericano de derechos humanos son escasas las ocasiones en que se aplica por la Corte Interamericana. Por tal motivo, el objetivo de estas líneas es señalar de manera muy general algunas diferencias y consideraciones para su posible aplicación en el Sistema Interamericano.

  The margin of national appreciation is created with the purpose of finding a more satisfactory relationship between the supranational bodies and the authorities of the State, in which some freedom of configuration or deference from the international jurisdiction is granted to one of the state powers. It appears in the European system for the protection of human rights, citing itself in various resolutions. On the other hand, from a comparative point of view, in the inter-American human rights system there are few occasions in which it is applied by the Inter-American Court. For this reason, the purpose of these lines is to point out in a very general way some differences and considerations for their possible application in the Inter-American System.
