Un importante inconveniente de la disposición testamentaria del «patrimonio digital» es la posibilidad de que los datos personales del testador queden comprometidos. Cualquiera de las personas que, de conformidad con la legislación notarial, tienen derecho a obtener una copia del testamento, puede tener conocimiento de las claves de acceso en él reflejadas. La solución pasa por la manifestación por parte del testador de una prohibición expresa en este sentido merced a una cláusula testamentaria de cuyo conocimiento y copia se prive a dichos sujetos o a un testamento complementario al general, en donde se incluyan las referidas claves, la designación de la persona o de las personas encargadas de la gestión de los datos y las correspondientes instrucciones al respecto.

An important inconvenient of the testamentary provision of the «digital heritage» is the possibility that the personal data of the testator are compromised. Any of the persons who, in accordance with the notarial legislation, have the right to obtain a copy of the will, may have knowledge of the access codes reflected therein. The solution goes through the demonstration by the testator of an express prohibition in this sense by virtue of a testamentary clause whose knowledge and copy deprives said subjects or a testament complementary to the general, which includes the aforementioned keys, the designation of the person or persons in charge of the management of the data and the corresponding instructions in this regard.
