Se analiza en este estudio la posibilidad de que el acreedor de una sociedad mercantil pueda dirigir contra sus administradores sociales, reclamaciones por daño cuantificado y concretado en la deuda de la sociedad impagada e insatisfecha al acreedor, a través de la acción individual, es decir, reclamando su responsabilidad civil. Ello afecta a aspectos netamente sustantivos relativos a dicho régimen de responsabilidad y también a importantes cuestiones procesales de indudable interés y trascendencia; carga probatoria, acumulación de acciones, competencia objetiva, prejudicialidad civil No podemos ni pretendemos abarcar todas ellas, pero si, al menos, realizar un breve apunte a modo de reflexión invitando a explorar este inabarcable "mundo" de la responsabilidad de los administradores sociales
This study analyzes the possibility that the creditor of a company may claim against its social administrators, damage which consists on the company debt, through the individual action, that is, claiming civil liability. This affects clearly substantive aspects related to this liability regime and also important procedural questions of undoubted interest and importance; probatory charge, accumulation of actions, court jurisdiction, prejudicial civil... We can not and we do not intend to cover all of them, but if, at least, make a brief note as a reflection inviting to explore this boundless "world" of the responsibility of social administrators.
