Diffamazione a mezzo facebook: legittimo il sequestro preventivo tramite oscuramento della pagina?

    Il contributo analizza se è consentita -ed in quali limiti- la misura reale del sequestro preventivo di taluni strumenti tramite i quali si diffonde al pubblico il pensiero umano; più in particolare, delinea i contenuti inseriti sui siti internet, nel senso di capire se alle pubblicazioni telematiche deve applicarsi la disciplina sulla stampa – che pone limiti al sequestro ma che prevede specularmente anche precipui obblighi – ovvero se devono applicarsi regole diverse in ragione delle differenze esistenti fra i due mezzi di comunicazione. In assenza di previsioni espresse sul punto, il sequestro preventivo del supporto o dello strumento telematico deve comunque ritenersi legittimo purché fondato su un’effettiva necessità e su ragioni di peso simmetrico alla libertà di esprimersi, consacrata dall’art. 21 Cost.

    The paper analyzes if it is allowed and to what extent the real measure of the seizure of certain instruments by which human thought is disseminated to the public; more specifically, it outlines the contents posted on the websites, in the sense of understanding whether the discipline on the press must apply to the online publications – which places limits on the seizure but which specularly also includes particular obligations – or if different rules must be applied due to differences existing between the two media. In the absence of forecasts expressed on the point, the preventive seizure of the support or of the telematic instrument is legitimate provided that it is based on an effective necessity and on reasons of weight symmetrical to the freedom of expression, consecrated by art. 21 Cost.
