Il contributo esamina gli spazi di ammissibilità della prova testimoniale rispetto al contenuto delle intercettazioni dando atto dell’esistenza di due posizioni contrapposte. La sentenza in commento evidenzia l’inesistenza di un espresso divieto di testimonianza in materia superando il precedente orientamento della Suprema Corte che, per lungo tempo, ha sostenuto la inammissibilità della testimonianza sul contenuto delle intercettazioni sul presupposto che potesse essere provato solo mediante la perizia trascrittiva delle registrazioni.

The contribution examines the eligibility spaces of the testimonial test with respect to the contents of the interceptions, acknowledging the existence of two opposing positions. The sentence in question highlights the inexistence of an express prohibition of testimony in this matter overcoming the previous orientation of the Supreme Court which, for a long time, supported the inadmissibility of the testimony on the content of interceptions on the assumption that it could be proved only by the transcriptional expertise of the recordings.
