    La gestación subrogada o gestación por sustitución es una técnica de reproducción asistida que lleva décadas practicándose en otros países con todas las garantías necesarias. Mucho se ha hablado de las cuestiones éticas y jurídicas que la rodean en nuestro país en los últimos años, dejando en un segundo plano las cuestiones psicológicas y sociales que tanto tiene que aportar a esas disciplinas. Por ello es necesario reflexionar sobre estos aspectos y ver de qué manera influyen y modulan el proceso, ya que son cruciales para poder dotar al mismo de las máximas garantías y evitar que las personas que en él participan sean víctimas de extorsión o explotación. La Gestación subrogada desafía los conceptos tradicionales de familia, maternidad y filiación, estableciendo una nueva forma de conformar una familia que tendrá que pasar la barrera de la aceptación social en cualquier país que pretenda regularse.

    Gestational Surrogacy is an ART (assisted reproductive technology) that has been used for decades in other countries with all the necessary guarantees. They have talked a lot about the ethical and legal issues of the surrogacy in our country in recent years, without paying too much attention on the psychological and social aspects that have much to contribute to these disciplines. For this reason, it is a must that we think on these subjects and we go into the way they affect and module the whole process as they are crucial to be able to bring the maximum guarantees and to avoid people that participates on it to become victims of extortion or exploitation. Gestational Surrogacy challenges the traditional concepts of family, motherhood and filiation, establishing a new way to create a family that will have to pass the frontier of social acceptance in any country that pretends to regulate it.
