    En este trabajo comentamos la Sentencia del Tribunal Superior de Justicia de Madrid en la que resuelve un recurso planteado por un jugador de rugby frente a la denegación de la condición de deportista de alto rendimiento por la Comunidad de Madrid. La parte actora fundamenta su postura en el hecho de que existe diferencia de exigencias según se haya nacido en la Comunidad de Madrid o fuera de ella, con lo que se está atentando al principio de igualdad recogido en el artículo 14 de la Constitución Española. Esta sentencia abre el debate de la necesidad de conexión con la Comunidad Autónoma que concede este derecho a los deportistas.

    In this work, we analyze the Judgment of the Supreme Court of Justice of Madrid in which it resolves an appeal raised by a rugby player against the denial of the status of high performance athlete by the Community of Madrid. The plaintiff bases their position on the fact that there is a difference in requirements according to whether they were born in the Community of Madrid or outside of it, which is undermining the principle of equality set forth in Article 14 of the Spanish Constitution. This ruling opens the debate on the need to have a connection with the Autonomous Community that grants this right to athletes.
