Este trabajo analiza la cuestión relativa a si supone una vulneración del derecho a la tutela judicial efectiva el hecho de que un tribunal nacional se aparte de la doctrina del Tribunal de Justicia de la Unión Europea sobre la condición de consumidor del fiador o garante de un préstamo mercantil y, en consecuencia, infrinja el principio de primacía del derecho de la Unión Europea. El Tribunal Constitucional español ha estimado el recurso de amparo interpuesto por un matrimonio que garantizó hipotecariamente un préstamo mercantil, por vulneración del derecho a la tutela judicial efectiva, al considerar que la Audiencia Provincial de La Rioja no seleccionó correctamente la norma aplicable, conculcando así el sistema de fuentes y el principio de primacía del derecho de la Unión.

This paper deals whit the issue about if Effective Judicial Protection Right is violated by the fact that a national court judgement diverges from EU Court of justice case law related to guarantor consumer status, and therefore, infringes European Union Law Precedent Principle, Constitutional Court considers entirely the writ of protection brought by a married couple, who mortaged their dweling for securing a commercial loan, understanding their Effective Judicial Protection Right has been broken by a national court judgement that didn't apply the suitable rule, violating the European Union Law Precedent PrincipIe.
