Distintas cuestiones prejudiciales planteadas al Tribunal de Justicia de la Unión Europea han puesto de manifiesto la problemática de los enlaces que permiten localizar obras en Internet; mediante su respuesta, los jueces de Luxemburgo han ido perfeccionando el régimen jurídico de los enlazadores en relación con los derechos de propiedad intelectual. El presente trabajo analiza la jurisprudencia que interpreta el concepto «acto de comunicación pública» respecto de la provisión de enlaces a contenidos protegidos, con el propósito de delimitar los requisitos que debe reunir la actividad desarrollada por el enlazador para ser considerado infractor directo de este derecho exclusivo.
The problems raised by links that enable to locate works on the Internet have been brought to light through different questions referred to the European Court of Justice. By means of their preliminary rulings, the Luxembourg judges have gradually sharpened the linkers legal regime in relation to copyrights. The following study analyses the case-law that interprets the concept «act of communication to the public» with regard to the provision of links to copyright-protected content. This paper is aimed at defining the requirements that must fulfil the activity of the linker in order to be considered a direct infringer of this exclusive right.
