Resumen de Criminalidade escrava no Brasil Imperial e estratégias da população escravizada diante da ordem jurídica do Império (1822-1889)

Prestigiosa corrente historiográfica defende o ponto de vista de que o escravo, destituído de personalidade jurídica e, por conseguinte, do status de sujeito de direito, foi reduzido socialmente à condição de coisa pelo sistema escravista imperial. Em sentido contrário, argumenta‑se neste artigo, com base no exame de casos judiciais concretos e na análise da legislação repressiva imperial, que a população escravizada desenvolveu conscientemente não somente estratagemas extrajurídicos, mas, também, estratégias jurídicas na defesa de seus interesses, inclusive na esfera penal. Demonstra‑se, assim, que a escravidão, ao contrário do que defende a historiografia tradicional, não logrou destituir o escravo de sua condição de sujeito social. Conservando a possibilidade de interação com indivíduos livres, a massa escravizada conseguiu, por vezes, lutar com sucesso em defesa de sua liberdade no interior do próprio sistema penal do Império.

Prestigious historiographic current endorses the point of view that slave, dismissed of legal personality and, therefore, of the condition of a subject of law, was socially diminished to the status of thing by the imperial slavery system. In opposition, this article asserts, based on the examination of concrete legal cases and on the analysis of the repressive imperial legislation, that the captive population consciously developed not only extrajudicial strategies, but also judicial ones in the defense of their interests, including at the criminal sphere. Thus, it shows that the slavery, on the contrary of what traditional historiographic advocates, did not enact to dismiss the slave of its condition of social subject. Sustaining the possibility of interaction with free individuals, the enslaved mob got, occasionally, to fight with success for the defense of their freedom within the own legal system of the Empire.
