  Contemporary societies credit to advocacy, exercised independently of the political and economic powers, an important role for social stability and the defense of the rights of individuals. The lawyer is not a professional exempt of criminal responsibility. The demarcation of what may constitute a «typical conduct», in order to distinguish the lawful action of the lawyer from the licit conduct concerning the fulfillment of the obligations and duties proper to the law, requires the knowledge of tools and analytical categories that have been developed in criminal law with the objective of providing criteria for decision‑making in this area. Considering the nuances of the advocacy practice that contemporary democracies recognize and which form a complex model, the definition of the activities that characterize it and the legal instruments that advocacy serves to fulfill its multiple and delicate functions delimit the normative scope that protects its abusive incriminating actions.

  As sociedades contemporâneas creditam à advocacia, exercida com independência em relação aos poderes político e econômico, relevante papel para a estabilidade social e a defesa dos direitos dos indivíduos. O advogado não é profissional isento de responsabilidade em âmbito criminal. A demarcação do que pode configurar “conduta típica”, para distinguir a ação delituosa do advogado das condutas lícitas concernentes ao cumprimento de obrigações e deveres próprios da advocacia, requisita o conhecimento de ferramentas e categorias analíticas que no âmbito do direito penal foram desenvolvidas objetivando fornecer ao jurista critérios seguros de decisão nessa matéria. Dadas as nuances do exercício da advocacia que as democracias contemporâneas reconhecem e que fundam modelo complexo, a definição das atividades que a caracterizam e dos instrumentos jurídicos de que a advocacia se vale para cumprir suas múltiplas e delicadas funções delimitam o âmbito normativo que protege o seu exercício de ações incriminatórias abusivas.
